All housing providers 1 in all states are subject to the federal Fair Housing Act, which includes seven protected categories:
• Race
• Color
• National origin
• Religion
• Sex
• Familial status
• Disability
Note that source of income is not included as a protected category in the federal law.
In addition to the federal FHA, almost every state has passed its own fair housing law, many of which have adopted language that simply mirrors the federal law. However, some states have opted to include additional protected categories in their state fair housing law, such as
• Veteran Status
• Gender Identity
• Ancestry
• Age
• Domestic Violence Victim Status
