WHY EVICTIONS ARE DISAPPEARING FROM COURT RECORDS AND WHAT LANDLORDS SHOULD DO ABOUT IT
The National Center for State Courts (NCSC), a nonprofit organization that works closely with court systems, is partnering with 24 courts nationwide to implement what are known as “eviction diversion programs.” These programs change how eviction cases move through the court process and often allow tenants to resolve disputes without an eviction judgment ever being entered. As a result, courts are issuing fewer eviction judgments, which leaves landlords with less visibility into an applicant’s rental history. In many cases, an eviction filing may take longer and still end without a public record that appears in a standard eviction search.
